Terms and Conditions

This English text is a translation provided for convenience. In case of any discrepancy, the Romanian version prevails.

1. General information

The website consvitraliu.ro is owned and operated by CONSVITRALIU RO SRL, a Romanian legal entity with its registered office in Șos. Ștefan cel Mare și Sfânt, Iași, Iași County, Romania, registered with the Trade Register under no. J2025094608000, tax ID 53052167 (“Consvitraliu”, “the Company”, “we”). Manufacturing is carried out by the affiliated entity in the Republic of Moldova, identified below.

Manufacturing is carried out by the affiliated entity in the Republic of Moldova. Data necessary for delivering projects may be shared with this entity, under the conditions described in the section on international transfers.

The Website is a presentation website for the Company’s activity (design, manufacturing, installation and support for glass, PVC and aluminium systems). The Website is not an online shop: it does not allow orders to be placed, does not process payments and does not provide online delivery of products.

Acceptance of terms. By accessing and using the Website you confirm that you have read, understood and accept these Terms and Conditions, as well as the Privacy Policy and the Cookie Policy. If you do not agree, please do not use the Website.

2. Definitions

• Website — all pages, content and functionality available at consvitraliu.ro, including its subdomains.
• User — any person accessing the Website, regardless of purpose.
• Client — the natural or legal person who contracts services or works from the Company under a separate contract.
• Consumer — a natural person acting for purposes outside their trade, business or profession, within the meaning of Romanian GO no. 21/1992 and GEO no. 34/2014.
• Services — consulting, measurements, design, manufacturing, installation, warranty and support for glass, PVC and aluminium systems.
• Quote request — a request sent by the User through the contact form, e-mail or phone, asking for a price estimate or information about the Services.
• Quote — the document sent by the Company in response to a Quote request.
• Contract — the written agreement between the Company and the Client setting out the subject matter, price, deadlines and execution conditions.
• Content — texts, images, graphics, logos, design, source code, the structure of the Website and any other published material.

Note: the Website does not offer user accounts and does not allow online orders. Definitions relating to “orders” and “user accounts” do not apply to this version.

3. Use of the Website

3.1. Access rules

The Website may be accessed freely, at no cost, for informational purposes and to request a quote. You undertake to use the Website in good faith, in accordance with the law and these Terms.

3.2. Prohibited conduct

The following are strictly prohibited:

• any attempt at unauthorised access to the Website, servers, databases or infrastructure components;
• testing, scanning or exploiting vulnerabilities without our prior written consent;
• attacks such as DoS/DDoS, code injection, introduction of viruses, malware or other harmful code;
• sending spam, automated messages, repeated unfounded requests or abusive use of the contact form;
• copying, reproducing, systematically extracting (including through unauthorised scraping or crawling) or republishing the Content, in whole or in part, without our prior written consent;
• using the Website for illegal, fraudulent or misleading purposes, or in a way that infringes third-party rights;
• circumventing technical protection measures or anti-spam mechanisms.

3.3. Right to restrict access

We reserve the right to limit, suspend or block access for any User who breaches these Terms, including by blocking their IP address, without prior notice and without liability for any resulting damage. We also reserve the right to notify the competent authorities.

4. Services presented

The Website presents, on an informational and general basis, the categories of services and solutions we offer: glass solutions, PVC systems, aluminium systems and related professional services.

• Descriptions, images, technical specifications and portfolio projects are illustrative and do not constitute a firm offer.
• Availability, lead times and prices are established individually for each project.
• We reserve the right to modify, update or withdraw published information at any time, without prior notice.
• Certain portfolio details (category, implemented solutions, location) originate from project documentation and can be further confirmed on request.

5. User accounts

Not applicable. The Website currently does not offer user account functionality. Should such functionality be introduced, these Terms will be updated accordingly.

6. Online orders, payments and delivery

Not applicable. The Website is not an online shop. No orders can be placed, no online payments are processed and no deliveries are made based on orders placed through the Website. Accordingly, we do not store full bank card data and we do not work with payment processors or couriers for operations carried out via the Website.

Payment for contracted services and, where applicable, delivery and installation are carried out under the Contract concluded separately with the Client.

7. Quote requests, quotes and performance of services

7.1. The quote request

By completing the contact form or sending a request by e-mail or phone, the User submits a Quote request. Submitting a Quote request creates no obligations for either party and does not constitute a contract.

7.2. Nature of initial quotes

Any price estimate or preliminary quote communicated before on-site measurements is indicative and informational. A quote becomes firm only after:

• measurements are taken and the actual technical conditions of the space are assessed;
• the final system configuration, materials and technical solutions are established;
• the Company sends a written quote and the Client provides written confirmation of it.

7.3. Price changes

The final price may be adjusted compared with the initial estimate where the actual project data differs from the information initially provided (dimensions, material type, installation conditions, accessibility, additional works requested, design changes). Any price change will be communicated and agreed in writing before execution.

7.4. Execution, cancellations and rescheduling

• Lead times are estimates and are confirmed in the Contract; they may be affected by material availability, site conditions or factors beyond our control.
• Appointments for measurements or installation may be rescheduled by either party with reasonable prior notice.
• Cancelling work that has already entered production may involve bearing the costs already incurred, under the terms of the Contract.

8. Right of withdrawal (consumers) and warranties

8.1. Right of withdrawal

As the Website does not allow distance contracts for the sale of goods to be concluded, the provisions on withdrawal from contracts concluded online do not apply through the Website.

Where a contract is concluded at a distance or off-premises with a Consumer, the Consumer benefits from the rights provided by GEO no. 34/2014, including, as a rule, a 14-day right of withdrawal. We draw attention to the statutory exceptions, in particular:

• goods made to the Consumer’s specifications or clearly personalised (Art. 16(c)) — a category that generally includes custom-made glass, PVC and aluminium systems;
• services fully performed, where performance began with the Consumer’s prior express consent and after they acknowledged losing the right of withdrawal (Art. 16(a)).

8.2. Warranties

• The legal guarantee of conformity is granted under GEO no. 140/2021 and the legislation applicable to services, in relations with Consumers.
• Any commercial warranty is set out for each project in the warranty certificate and the Contract, which state its duration, scope and the conditions of use and maintenance.
• The warranty does not cover defects resulting from improper use, non-compliant maintenance, unauthorised interventions, mechanical damage or external causes.
• Complaints regarding conformity should be sent to office@consvitraliu.ro or by phone at 0721 161 161, describing the issue and attaching supporting documents.

9. Intellectual property

All Content on the Website — the Consvitraliu name and logo, the trade mark, texts, project photographs, production images, iconography, design elements, structure, source code and database — is the property of the Company or is used by it under a valid licence, and is protected by Romanian Law no. 8/1996 on copyright and related rights and by trade mark legislation.

• Copying, reproducing, distributing, publishing, modifying, transmitting or commercially exploiting the Content, in whole or in part, without our prior written consent is prohibited.
• You may view the Content and print or download extracts solely for personal, non-commercial use, keeping all copyright notices.
• No licence over trade marks, logos or other intellectual property rights is granted, expressly or implicitly.
• Third-party trade marks mentioned on the Website (e.g. names of system and material manufacturers) belong to their respective owners and are used purely descriptively.

10. User-generated content

The Website does not currently allow the publication of comments, reviews or other user-generated content. The only information submitted by Users is that from the contact form, which is not published.

Should such functionality be introduced, we reserve the right to moderate, edit or remove any illegal, offensive, defamatory, discriminatory content, content that infringes third-party rights, or spam and unauthorised advertising.

11. Links to third-party websites

The Website may contain links to third-party websites or resources, included solely for the User’s convenience. We have no control over their content, policies or practices and accept no liability for them.

12. Limitation of liability

• Information published on the Website is general and informational and does not constitute technical, legal or other advice. Decisions taken solely on the basis of this information, without prior consultation and measurements, are made at the User’s risk.
• We make reasonable efforts to keep information accurate and up to date, but we do not guarantee the absence of errors, omissions or technical inaccuracies.
• We do not guarantee uninterrupted, error-free or risk-free operation of the Website. The Website may be temporarily unavailable due to maintenance, updates or causes beyond our control.
• To the extent permitted by law, we are not liable for indirect damages, loss of profit, data or opportunity resulting from the use of or inability to use the Website.
• Force majeure and fortuitous events exclude liability, under Art. 1351 of the Romanian Civil Code.
• Nothing in these Terms limits or excludes our liability where the law does not permit it, and nothing affects the mandatory rights of Consumers under Romanian and European law.

13. Complaints and dispute resolution

• Direct complaints: please contact us first at office@consvitraliu.ro or 0721 161 161. We will review the complaint and respond within 30 days.
• National Authority for Consumer Protection (ANPC): Consumers may contact ANPC — anpc.ro.
• Alternative Dispute Resolution (ADR): under Romanian GO no. 38/2015, Consumers may address the ADR entities within ANPC.
• Online Dispute Resolution (ODR): as the Website does not allow contracts to be concluded online, this route is generally not applicable.
• Governing law: Romanian law.
• Competent courts: the Romanian courts at the Company’s registered office. For Consumers, the jurisdiction rules established in their favour by European and Romanian law remain applicable.

14. Personal data protection

The processing of personal data is described in the Privacy Policy. The use of cookies and similar technologies is described in the Cookie Policy. Non-essential cookies are only activated with your consent, which you may withdraw at any time from “Cookie settings”.

15. Changes to the Terms

We reserve the right to amend these Terms at any time. The applicable version is the one published on this page at the time you access the Website. Continued use of the Website after changes are published means you accept them. This rule concerns only the Terms and Conditions and does not apply to non-essential cookies, for which explicit consent expressed through a clear affirmative action is required.

16. Final provisions

• If any clause of these Terms is declared void or unenforceable, the remaining clauses remain in force.
• Failure by the Company to exercise a right does not constitute a waiver of that right.
• These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire understanding regarding the use of the Website.
